Privacy Statement On our web sites, we have a policy of collecting limited personally identifiable information. The only time we require contactable information is when a user wants to enter a competition and these are only available to people over 18 years of age. Also the feedback and review forms require an email if you need a reply. If you do not need a reply you can contact us using the feedback and review form and there is no need to enter your email address. Any information that you do send to Betty Bookmark Ltd becomes the property of Betty Bookmark Ltd and can be used, edited and/or published by Betty Bookmark Ltd. Betty Bookmark Ltd will never publish your email address or contact information. If you send a book or film review, Betty Bookmark Ltd can publish your name and review on 'our web sites', but will never publish your contact information. Date for delivery: Up to 28 working days after application received. By agreeing to these terms you agree to indemnify us against any loss or damage caused to you, or our site or its reputation as a result of any failure by us, or on our behalf. You agree to indemnify and hold Betty Bookmark Ltd harmless from any dispute which may arise from a breach of terms of this Agreement. You agree to hold Betty Bookmark Ltd harmless from any claims and expenses, including solicitors fees and court costs, related to Customer's violation of this Agreement, including the Terms of Service or any Content placed on the Service by you. Competitions By entering a Competition, entrants agree to be bound by these Rules. Competitions are organised by Betty Bookmark Ltd. Betty Bookmark Ltd reserves the right to cancel or amend the Competition, or these Rules at any time without prior notice. Any changes will be posted either within the Competition or these Rules. In the event of any dispute regarding the Rules, Competition, conduct, results and all other matters relating to a Competition, the decision of Betty Bookmark Ltd shall be final and no correspondence or discussion shall be entered into. To qualify to enter the Competition you must be resident in the United Kingdom and over 18 years of age. Betty Bookmark Ltd reserves the right to request written proof of age of any winner. Betty Bookmark Ltd reserves the right to verify the eligibility of all entrants. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. Betty Bookmark Ltd reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions. In the event that any entrant is disqualified from the Competition, Betty Bookmark Ltd in its sole discretion may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules. Only one entry per person per Competition is allowed. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry. There is no purchase requirement to enter a Competition and there is no charge to register for use on 'our web sites'. Proof of posting cannot be accepted as proof of delivery. Betty Bookmark Ltd cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. Entrants should note that unless stated otherwise, Betty Bookmark Ltd does not accept responsibility for the return of any Competition entries, including those consisting of artistic or other material. Prize winners will be chosen at random unless specified otherwise in the Competition, from all qualifying entries within 28 days of the closing date specified in the Competition. In all matters, the decision of the judge(s) and Betty Bookmark Ltd team shall be final and no correspondence or discussion shall be entered into. Prize winners will be notified by email and have 28 days from the date the prize notification email is sent by Betty Bookmark Ltd to respond with the postal address so that the prize can be sent out to them. Return of any prize notification as undeliverable or failure to reply within 28 days of the prize notification email being sent out may result in disqualification and selection of an alternate winner or other disposal of the prize. If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)’ names will not be published or released in line with our Privacy Statement. Claims for prizes must be made within 28 days of the prize notification email being sent. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner or other disposal of the prize. Prizes are non-transferable and there is no cash alternative. Betty Bookmark Ltd reserves the right to substitute prizes of equal or greater value at any time. Prizes are awarded at Betty Bookmark Ltd's discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner. In consideration of Betty Bookmark Ltd agreeing to consider entrants to the Competition, each entrant hereby assigns to Betty Bookmark Ltd the complete copyright and all other rights in any entry, which shall be for the full period of copyright. Betty Bookmark Ltd shall be free to assign such rights to third parties. Furthermore, any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Betty Bookmark Ltd reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same. Betty Bookmark Ltd cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize. Betty Bookmark Ltd is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and our Privacy Statement and will not be disclosed to a third party without the individual's prior consent. The Competition and the terms and conditions of this agreement will be governed by English law. Ownership of data supplied You acknowledge that the service contains information, photos, video, graphics, music, sounds or other material (collectively, "Content") that are the property of Betty Bookmark Ltd. You cannot copy it, publish it or reproduce it to any third party without our express agreement in writing. All trademarks remain the property of their legal owners. Amendments This agreement can only be amended by the amendment of the terms on this page. You agree that it is your responsibility to check here for any changes. Currency All figures mentioned on this site or by Betty Bookmark Ltd employees are in pounds sterling unless otherwise agreed in writing. Images Betty Bookmark is the registered trademarks of Betty Bookmark Ltd. Images contained herein can not be duplicated or resold as any other form of publishing, clip art, or graphic resource. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the Content, in whole or in part. You may not upload, post, reproduce or distribute Content. The law that applies Betty Bookmark Ltd are based in England. This agreement will be governed by and construed in accordance with English law. No effect will be given to any principle of conflict of laws. This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral between Betty Bookmark Ltd representatives and yourself. Severance If any parts of this agreement are found to be unenforceable, void, illegal or invalid they shall be severed from this agreement and all other provisions will remain in force in full. |
